- There is no mechanism for appropriated funds to follow persons with DD from Nursing Homes to more appropriate community settings.
- Persons with DD cannot access appropriated funds through the PAS (through VR) and CIL because of rigid policies regarding the interpretation of "self-direction."
- Numerous agencies serve persons with disabilities. Each have different eligibility criteria with some having entitlement status and others with limited funding which creates ;arge waiting lists that do not move at a reasonable pace.
- There is no common application form or means for agencies to share databases to reduce redundancies within the service system.
- Informed Choice is negated when agency admission criteria are predicted on entitlement programs.
- Basing service availability to persons with disabilities solely on Medicaid eligibility is a violation of the ADA.
